Jurisdiction
The State Government of Sikkim vide notification no. 54(103)Home/93/38 dated 5th July, 1994 divided the whole of Sikkim in two Sessions Divisions, one for East and North Districts and the other for South & West Districts of Sikkim with their headquarters at Gangtok. The local jurisdiction of the District & Sessions Judge (South) and District & Sessions Judge (West) covers the whole of South and West revenue districts of Sikkim respectively. He/She exercises all or any of his/her powers within his/her local jurisdiction as per the provisions laid down in the Cr. P.C, 1973 (as amended till date).
Local Jurisdiction in relation to a Court or a Judge or a Magistrate means the local area within which the Court or the Judge or the Magistrate may exercise all or any of its or his powers under the Code of Criminal Procedures and such local area may comprise the whole of the State or any part of the state, as the State Government may, by notification, specify. [Under Section 2(j) Cr. P.C. , 1973 (as amended till date)]

BAR Association of Namchi was established on the 3rd day of August 2003 with its headquarters at Namchi District Courts Complex, P.O. and P.S. Namchi, South District, Sikkim.

GUIDELINESGUIDELINES FOR LITIGANTS VISITING OUR COURTSLitigants to take care of the following while appearing in Courts:-
Do not interfere in the proceedings while the learned Judge is busy in other matters.
-
Wait for your turn till your case is called out.
-
Do not come near the dais and stand; except to appear in your own case.
-
Do not discuss the merits of your case with the staff; contact your lawyer and discuss your matter with him only.

Do not bribe the staff; if a bribe is demanded by the staff, please bring it to the notice of Ld. Judge.
-
The staff in the Courts are courteous, be courteous in turn.
-
Wait for your turn when the staff members are otherwise busy in attending to similar requests.

Do not bring any arms, weapons, cameras etc. into the court premises.

Switch off your mobile phone before entering the court room.
-
Do not litter, spit or spoil the court building and furniture.
-
Do not talk loudly or assemble in the corridors and in the court room.
-
Do not bring other people with you if they are not parties/witnesses in the case.

It is advisable not to bring children to Court unless their presence is necessary.
-
Do not smoke in the court premises as it is a ‘No Smoking Zone’.

Do not violate the court etiquette or write letters directly to the Judge or to superior courts.
-
Park your vehicle at the proper parking place and do not leave the same on the road.

Please mention your age with your name and also try to mention age of other parties in pleadings so that cases of senior citizens may be taken up on priority.
